• By using any of our products you are accepting the health risks involved and you agree that upon using any of our products you will not hold E HOOKAH responsible or liable in any way or form for any health related problems that may be a result of using our products. You are also agreeing that you understand that you should not be using our products if you are nursing, pregnant of suffering from heart disease, diabetes or high blood pressure. It is the customers responsibility to consult their physician prior to using any smoking product that is offered by this company. 

• Anytime you send E HOOKAH an e-mail, login or access our website you are communicating with us in an electric format. By contacting us you are giving us permission to communicate back to you in the same electronic format. Please refer to our privacy policy for more information.

• If you choose to create an account on our site, you are responsible for maintaining the confidentiality of your account, user name, password and for restricting access to your computer. You also further agree to accept responsibility for all activities that occur under your account or password. If you believe that someone may have hacked your account or be using your user name and/or password contact us immediately. We will not be responsible or liable for any activity that has occurred on our site prior to you contacting us. 

• Any information you supply us when doing business with us or in creating an account such as, email address, shipping addresses, billing address, name, phone numbers, birthdates, contact information will never be released or sold to anybody. E HOOKAH takes its customers information and confidentiality very seriously, whenever you enter sensitive data into our site, it is encrypted using SSL and all your information is stored in our private servers. • E HOOKAH only offers its services and products to persons 18 (eighteen) years of age and older. If you are under 18 you are not permitted to use our site or any of our products, promotions or offers in any way, if you are found to be in violation of this policy or in violation of any of our terms and conditions put forth in either our terms and conditions of our privacy policy, E HOOKAH will refuse service, terminate all of your accounts, remove or edit content, and/or cancel orders immediately, and may seek legal action towards you.

• E HOOKAH attempts to be as accurate as possible when posting content on our site or in relation to any of our products or services. E HOOKAH takes no responsibility for misinterpreted content on our site by the consumer. If you feel we are not being clear about any of our services or products feel free to contact us and we will do our best to amend the situation. 

• The prices displayed for E HOOKAH products represent the full suggested retail price. Where an item is offered for sale by one of our merchants, independent sales representative or distribution agents, the price may be provided by that merchant and may differ from those prices shown on our website. 

• If any of our products are found to be advertised for sale on another website or store for a lower price, or a promotional sale price, E HOOKAH does not offer refunds for the price difference. Once you have confirmed your order upon checkout this means that you accept these terms and conditions and you agree to pay the full price given to you upon checkout. If a non authorized dealer or vendor quotes prices for any E HOOKAH product different from our website, your only solution is to settle any dispute with that said dealer or vendor. E HOOKAH takes no responsibility for prices put forth by non authorized dealers or vendors of E HOOKAH products.

• E HOOKAH reserves to the right to change our prices or services at our discretion, the final price for our products can not be confirmed until your order has finished processing. 

 

• We offer all our customers free shipping via USPS (United States Postal Service) ground, on all orders over $55USD to all US based destinations excluding Hawaii and Alaska. 

• All other shipping services we offer are calculated by weight, size, destination and delivery speed, the shipping prices shown on checkout represent the rates of the shipping companies.

• If an item is being returned for an exchange or repair due to a defect that our warranty covers we will cover all shipping costs however it is the customers full responsibility to ensure that the returning products are packaged appropriately. We do not cover any items that are returned to us damaged due to packing negligence caused by the customer. For items found to be defective and covered by our warranty we will also return the repaired item or replacement product back to you free of charge. 

• All items purchased from ehookahbrand.com or any E HOOKAH sales/distribution agents that must be shipped to the customer involve the use of a shipping carrier. E HOOKAH uses UPS and USPS (United States Postal Service) to ship all its products. These shipping carriers have their own terms and conditions of use, were applicable you agree to the individual shipping contracts of either UPS or USPS, whichever you are using to have your purchases shipped. This means that the risk of loss or damages caused during shipping is between you and the shipping company. However in the unikely event of a lost package or if a package is damaged during shipping we will work with you and the shipping company to resolve the issue.

 

• Any item being returned to us is the customers sole responsibility to cover all return shipping costs, unless otherwise written, and to ensure that the products or items being returned are packaged appropriately. We will not offer a refund on any products that are returned to us damaged as a result of packing negligence on behalf of the customer.

• Only packages that are returned to us with all original contents are entitled to a refund.

 

• We offer a 12 month limited warranty on all defective parts and the battery. This means we will repair or replace any parts that are found to be defective due to a manufacturing default with the product.

• We will not offer a free replacement or repair of any products that are returned to us for any of the following reasons: Damage due to human error, burnt out or normal wear on Atomizers or Clearomizers, normal wear on the battery unit, negligence or abuse, using the product in a manner in which is not consistent of the included instructions of use, normal wear and tear, Items that have been modified or altered in any way, Items that have been used other than what they are intended for, water damage, damage caused to any of our products by using any other Vapor Flavors or E-liquid other than our E HOOKAH Vapor Flavor line or damage caused by using any parts other than authentic original E HOOKAH parts.

• We do not offer refunds on returns of any of our Vapor Flavors. All sales are final. If Vapor Flavor is returned to us by mistake we will not offer any refund. If Vapor Flavor was returned to us by a mistake by a customer not understanding our policy, we can return it within 30days providing that the customer pays for all shipping costs.

 

• We offer exchanges on all products returned to us in new unopened condition. To file for an exchange use our return form and choose the exchange option. All shipping costs are the sole responsibility of the customer for all exchanges.

 

• Please make sure that the item you are returning meets all the conditions of our return policy prior to requesting a refund or exchange. To issue a refund or exchange click on the return button located at the bottom of the site under customer service. Fill out the form selecting the appropriate details and press continue at the bottom of the page. Your form will reach our return customer service department and we will issue you with a RMA (Return Merchandise Authorization) number and details on how to send your item back to us. Ensure that the returning products are packaged correctly and include your RMA number and form with your shipment. Once we have received your returned merchandise our return department will inspect the items and either issue you with a refund or replacement.

 

• Any dispute relating in any way to your visit to ehookahbrand.com, products you purchase through ehookahbrand.com or any disputes that arise with dealing with E HOOKAH shall be handled in the state of Maryland and its legal system, except that, to the extent you have in any manner violated or threatened to violate E Hookah’s intellectual property rights, E HOOKAH may seek injunctive or other appropriate relief in any state or federal court, and you consent to exclusive jurisdiction and venue in such courts. 

 

• By visiting or using ehookahbrand.com, purchasing or using any of our products you agree that the laws of the State of Maryland, USA, without regard to principles of conflict of laws, will govern our companies policies and the conditions of use. Any dispute that might arise between you and E HOOKAH or its affiliates are subject to the laws of the state of Maryland, USA.

• E HOOKAH and ehookahbrand.com are governed by all applicable international, federal, state and local laws. All information available on ehookahbrand.com is subject to U.S. export control laws and may also be subject to the laws of the country where you reside.

• If any provision of these Site Terms shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining terms and conditions or policies of E HOOKAH and its affiliates.

• E HOOKAH reserves the right to change or modify our terms and conditions and/or privacy policy without any notice to the consumer. Further E HOOKAH reserves the right to change any and all content contained on this site at any time without notice.
